What California Law Criminalizes Under HS 11352

The statute reaches further than most defendants expect. Health and Safety Code 11352 makes it a felony to sell, furnish, administer, give away, transport for sale, or import certain controlled substances into California and also to offer or attempt any of those acts. You don’t need to complete a transaction to face charges. An offer to sell to an undercover officer can be prosecuted even if no drugs changed hands, as long as the prosecution can show intent.

Physical possession isn’t required either. Constructive possession (dominion and control over drugs without physically holding them) is enough. Someone who directs a delivery without touching the product can still be charged. Transportation doesn’t require crossing county lines. Moving controlled substances within the same city can trigger the statute if the prosecution proves the movement was for purposes of sale.

HS 11352 covers heroin, cocaine, opiates, and related narcotics. Methamphetamine distribution is charged separately under HS 11379, and marijuana under HS 11360.

Felony Penalties for a HS 11352 Conviction

A standard conviction can carry three, four, or five years in county jail and a fine of up to $20,000. Those numbers can increase substantially depending on the facts of the case.

  • Multi-county transportation: Moving drugs across two or more non-contiguous county lines in California can raise the range to three, six, or nine years
  • Weight enhancements under HS 11370.4: Large quantities can add three to 25 years and increase fines up to $8,000,000
  • Proximity enhancements: Selling within 1,000 feet of a drug treatment center, detox facility, or homeless shelter may add one year
  • Involving minors: Using a minor to transport or assist in drug activity can bring additional felony charges

A felony distribution conviction follows a person well beyond the end of their sentence. For non-citizens, including lawful permanent residents, a conviction under HS 11352 can be a deportable offense under federal immigration law. Even a plea to a reduced charge can trigger immigration consequences, and a suspended sentence doesn’t eliminate that risk.

Professional licenses in medicine, nursing, teaching, and contracting can be revoked. Background checks run by employers, landlords, and lenders can show the felony. Federal student financial aid can be suspended. And if a defendant has prior qualifying convictions, a drug distribution conviction may count as a strike under California’s Three Strikes Law, with a third qualifying strike carrying a mandatory minimum of 25 years to life when the third offense is itself a serious or violent felony.
