Drug Manufacturing Attorney in Manteca

Former-Prosecutor Insight Into Drug Manufacturing Allegations

A drug manufacturing allegation often turns on whether prosecutors can connect a person to an alleged production process. Finding chemicals, equipment, containers, or protective gear does not by itself establish who controlled those items, what process occurred, or whether the accused knowingly participated.

California law does not necessarily require prosecutors to prove that a finished controlled substance was produced. Knowing participation in beginning or intermediate steps of a manufacturing process may be enough, depending on the evidence and the charged conduct.

If you are under investigation, have been arrested, or are helping a family member, early legal guidance can help you understand the decisions ahead. Attorney Phillip Krueger's prior work as a prosecutor informs how we assess the government's theory, the search, and the claimed connection between the accused and the location or materials.

California Health and Safety Code Section 11379.6

California Health and Safety Code section 11379.6(a) addresses manufacturing, compounding, converting, producing, deriving, processing, or preparing specified controlled substances through chemical extraction or chemical synthesis.

A conviction under subdivision (a) carries a term of three, five, or seven years pursuant to Penal Code section 1170(h), along with a potential fine of up to $50,000. Where and how a custodial term is served can depend on the sentence and the defendant's circumstances.

Subdivision (e) separately addresses offering to perform conduct prohibited under subdivision (a) and provides a term of three, four, or five years.

The prosecution does not necessarily need to prove that a manufacturing process was completed. California law can reach knowing participation in beginning or intermediate manufacturing steps.

Additional aggravating factors or enhancements may apply depending on the substance, location, people present, prior record, and other circumstances. Allegations involving methamphetamine, minors at a location, occupied structures, or certain volatile-solvent extraction methods can raise additional sentencing issues.

How We Examine the Prosecution's Evidence

Manufacturing investigations can rely heavily on physical and forensic evidence. Prosecutors may use search-warrant affidavits, photographs or video, inventories of seized materials, communications, and laboratory analysis.

Important questions may include:

  • Search Legality: Was the search supported by a valid warrant or another lawful basis, and was its scope properly limited?
  • Forensic Reliability: Were samples properly preserved, documented, and analyzed?
  • Chain of Custody: Does the record establish who collected, handled, transferred, and tested the evidence?
  • Control of the Location: What actually connects the accused to the property, room, vehicle, equipment, or materials?
  • Knowledge and Participation: Does the evidence establish knowing participation in manufacturing rather than mere presence, proximity, or association?
