Eligibility Under Penal Code 1203.4

Most people who qualify for a standard PC 1203.4 expungement share a few characteristics: a felony or misdemeanor conviction for which probation was granted, successful completion of all probation terms (including fines, restitution, and required programs), and no current charge, probation, or sentence on another offense.

Several factors complicate eligibility in ways worth understanding:

State prison sentences: Most convictions that resulted in a California state prison term don’t qualify for a standard 1203.4 expungement. Certain felonies sentenced to county jail under Penal Code 1170(h) may still be eligible, however.
Probation violations: A prior violation doesn’t automatically disqualify someone. A court may still grant expungement at its discretion after weighing the nature of the violation and the person’s conduct since.
Wobbler reductions: A “wobbler” is an offense a prosecutor could charge as either a felony or a misdemeanor. If your conviction was a wobbler, it may be eligible for reduction to a misdemeanor as part of the record-clearing process, which may restore rights lost because of felony status, including voting rights and, in some cases, firearm rights.

How the Petition Process Works in San Joaquin County

Petitions are generally filed with the court branch that handled the original case. For matters arising in South County, that means the Manteca Branch of the San Joaquin County Superior Court. Once filed, the prosecuting attorney is served and may object. A court can still grant the petition if it finds relief is in the interest of justice, but that determination isn’t automatic.

What an Expungement Does and Doesn’t Change

A granted expungement changes your conviction’s status to “dismissed,” which provides meaningful employment-related legal protections. Most private employers can’t use an expunged conviction to deny you a job. But the case doesn’t disappear from the record entirely. It can still appear on some background checks, marked as dismissed rather than convicted.

A few situations where an expunged conviction still carries legal weight:

Public office and state licenses: You must still disclose an expunged conviction when applying for certain state licenses or running for public office.
Sentencing in future cases: An expunged conviction can still be used as a prior conviction for sentencing enhancement purposes in a later criminal proceeding, particularly if you’re charged with a similar offense.
Testimony: If you testify in a later case, the expunged conviction may be used to challenge your credibility.

California’s Clean Slate Act & Automatic Relief

California’s Senate Bill 731, known as the Clean Slate Act, took effect July 1, 2023, with some provisions implemented as of October 1, 2024. Under this law, the California Department of Justice reviews its statewide criminal database monthly, identifies people eligible for automatic relief, and notifies the relevant court. No petition is required for those who qualify.

The general timelines: most felony convictions become eligible for automatic sealing four years after the case closes, while felony arrests that didn’t result in charges are sealed after three years. This automatic relief doesn’t apply to serious or violent felonies or to offenses requiring sex offender registration, and it doesn’t restore firearm rights taken away due to a qualifying conviction.

Automatic relief covers a meaningful portion of eligible Californians, but it isn’t universal. People whose convictions fall outside those categories, or who need documented relief sooner, can still pursue a Penal Code 1203.4 petition through the court.

Felony Reduction & Certificate of Rehabilitation

Two additional forms of post-conviction relief are worth knowing about, depending on your situation.

Wobbler Felony Reduction
If your felony conviction was for a wobbler offense, a reduction to a misdemeanor may be available as part of the record-clearing process, separate from the expungement dismissal itself. A reduction can meaningfully change your legal status, particularly regarding rights that attach to felony convictions.

Certificate of Rehabilitation and Pardon
For San Joaquin County residents who completed a state prison sentence, a Certificate of Rehabilitation is a court order reflecting that a person has been rehabilitated. It doesn’t erase the underlying record, but it updates what that record says. In some cases, it can serve as a direct application for a Governor’s Pardon. This may be available in addition to, or instead of, a standard expungement, depending on the conviction.
